is concerned, prisons and juvenile facilities reflect but a fraction of the overall correctional process that more predominantly involves probation, parole and/or other alternative approaches beyond incarceration (Petersilia, 2006).
The filter begins the moment the perpetrator is detained, inasmuch as it is initially determined whether he will be arrested or let go; if he is detained and released, he
has experienced the fastest form of the filter, but if he is arrested he begins a process that takes him through a number of determinants that pertain to his ultimate
correctional method. The filters ultimate end is found with the five percent of offenders who end up with prison sentences (Petersilia, 2006), however, there are myriad spots along the
journey where it can stop abruptly, not the least of which includes going all the way through trial yet having the jury fail to convict. This particular offenders filter
ends with him walking out the courtroom once again a free man (Petersilia, 2006). A number of entities are involved with the correctional filter from judges to attorneys to the
state, the latter of which "has the burden of proving criminal liability beyond a reasonable doubt and is not always able to do so" (Petersilia, 2006). California has been
