inmates with the total number of people in jail increasing by an astounding 47 percent (Freudenberg 9). These jailed individuals typically fall into four categories of violent offenses, property
offenses, drug offense, and public order offenses such as probation and parole violations, driving while intoxicated, weapons charges, traffic citations, and obstruction of justice convictions (Freudenberg 9). For this
reason, overcrowding within the nations jail systems has grown within the past decade to astronomical proportions. There are numerous causes of this overcrowding. First, since the terrorist attacks of
September 11, 2001, there has been a significant number of jailed immigrants and non-citizens of the United States, which comprised up to 40 percent of incarcerated individuals on a federal

Prior to the passage of this anti-drug legislation, the prison population was about three-quarters less than it is today, thanks to up to 75 percent of inmates presently serving drug
