Farmers Insurance Groups liability division conducted an extensive claims study that examined 503 labor and delivery-related claims made between January 1, 1991
and December 31, 1995 that while labor and delivery claims represented only roughly six percent of hospital and physician claims made during this period, it account for more than 11
percent of total dollars spent (Rommal, 1996). The legal theories of corporate liability and respondeat superior (i.e., "let the master answer") make hospitals easy targets for obstetric malpractice suits (Rommal,
1996). Under the theory of corporate liability, the hospital can be held liable for any breach of its duty. Furthermore, the hospital can also be held responsible under the theory
of respondeat superior for the negligence of any hospital employee (Rommal, 1996). When a health care provider is sued for any form of perceived malpractice, it is generally under
the theory of negligence (Martin, 2000). Negligence is a form of tort that considered to arise from an injury created by conduct that deviates from a "standard of care" (Martin,
