engender conflict. It was against this background that Sir John Egan made the ground breaking report Rethinking Construction. This is a report that is attempting to make some great
changes to the construction industry, increasing profitability, competitive and good practices. The report is put forward and a win win scenarios, for all involved, but to operate within the framework
it lays down there are many challenges. The traditional conflicting model of contracts is questioned with a greater emphasis placed on partnerships. In order to understand the impact that this
will have on the construction industry and the challenges it will pose the recommendations themselves have to be considered in order to understand how this will impact on the contract
and dispute resolution. This report looked at the construction industry as a whole, and the ways in which it needed to improve.
In making his recommendations to the government the Sir John Egan stated; "In formulating our proposals for improving performance we have studied the experience that has been gained at the
cutting edge of construction and in other industries that have transformed themselves in recent years. We have learnt that continuous and sustained improvement is achievable if we focus all our
efforts on delivering the value that our customers need, and if we are prepared to challenge the waste and poor quality arising from our existing structures and working practices" (Sir
