While upholding certain freedoms of expression, such as commercial advertising and the right to vote, the courts have stated that hate speech and violence of expression are contrary to the Constitution and the Canadian Charter of Rights and Freedoms. Of course, the justices have their opposing arguments, such as Justice McIntyres impassioned plea for human rights for all Canadians in R. v. Keegstra, [1990] 3 S.C.R. 697. This opposed to more balanced arguments against decisions, including hers in Canada (Human Rights Commission) v. Taylor, [1990] 3 S.C.R. 892. In the end, freedom of expression is upheld by the courts to reflect the traditional view. At the same time, dissentions have left some room open for more nontraditional interpretations.
