has been a hotly contested issue for more than a year. It, in fact, polarized the 2004 presidential election, with a ban on gay marriages being voted on in 11
states. Yet on the other hands, states such as Massachusetts and Oregon have ruled in favor of civil unions as it pertains
to gay marriages. The issue has become so heated that even President George W. Bush has become involved, insisting that there should
be an amendment to the constitution supporting the idea that marriage should feature a legal commitment between a male and a female.
In this paper, well argue why such an amendment should be passed. Mr. Bush has introduced the idea of the amendment to,
in his words, protect the "most fundamental institution of civilization" from judges who might want to issue licenses to gay couples (The Economist, 2004). The difficulty here is whether or
not banning gay marriages constitutes a violation of freedom of speech (or freedom of expression, in this case, the "expression" to love another, even if he/she is the same sex).
It could be said that the ban, as well, could likely violate the concept of equality, which is also implied in the Constitution (The Economist, 2004). Most justices view the
idea that the constitution demands equal treatment of all U.S. citizens, no matter what they might want to do in their private lives (The Economist, 2004; see also Mohr, 2004).
