Furthermore, under the section entitled "The Right to Timely and Adequate Health Care," the author explores various legal cases that indicate that health care for prisoners in various states has been found to be inadequate in the past. The health status of prisoners within the federal system is a significant issue for nursing investigation, as prisons are a clinical setting in which nursing is practiced. Study Purpose : The US Constitution guarantees all citizens, including prisoners incarcerated by the Federal Bureau of Prisons (FBOP), specific rights, such as the prohibition in the Eighth Amendment banning cruel and unusual punishment. The purpose of this study is determine whether or not the standards established by "Congressional mandate, Supreme Court rulings, and policy directives" from the US Department of Justice Health Services Manual are being met within the FBOP (Murphy, 2005, p. 23). Research Question : Are federal prisoners rights to medical care, which are guaranteed under the Constitution and mandated by Congress and the Department of Justice, being met? Study Design : The researchers in this study qualifies as a "Convict Criminologist," that is, an "ex-prisoner who has academic training" (Murphy, 2005, p. 23). As a prisoner, the author observed prison culture from the perspective of a participant. Various qualitative methods were employed to analyze the elements of the prison health care delivery system. These include identifying variables, ethnographic research, comparison of observations and analysis of transcription of interview notes.
