part of the much-prized legacy of American liberty, but such a policy becomes both reasonable and logical when the lexicon of political correctness is abandoned and such speech is labeled
for what it is-hate speech. The speech that this policy would ban would not constrain the free exchange of ideas that is so vital to discourse within any institution of
higher education and so necessary to the accomplishment of learning goals. What hate speech refers to has been summarized eloquently by Mari Matsuda, a law professor at Georgetown University,
who characterizes hate speech in terms of actions as well as words. She describes "hate speech" as when a student comes back to her dorm room to find "an anonymous
note calling her ancestors filth" or to return to a study carrel, after taking a break, to find that someone has "drawn swastikas" in the margins of open textbook and
across class notes (Matsuda 151). As this suggests, Matsuda believes that the Constitution and the Bill of Rights should be interpreted according to the messages it contains in its
entirety (Matsuda 150). In proposing bans on hate speech, Matsuda is speech whose "only function...is to wound and degrade by asserting the inherent inferiority of a group" (Matsuda 151).
In some manner or fashion, all university students constitute a group that is particularly at-risk for psychological harm due to either age-related developmental issues or feelings of vulnerability that evolve
from their particular life circumstances (Matsuda 151). Therefore, exposure to hate speech and actions can be particularly disconcerting and devastating to the students at whom the unreasoning hatred is
