U.S. Supreme Court ruled that baseball was not a business and therefore was not subject to the anti-trust laws that impacted other businesses (Sensenbrenner, 2001). This is an exemption that
lasts to this day - and interestingly enough, this exemption is used only by Major League Baseball - none of the other sports associations have this exemption (Sensenbrenner, 2001).
Needless to say, there are critics crying "foul" every time the exemption rears its head (typically during players strikes or an attempt by
a baseball team to force a city to build a stadium for it). The question were trying to answer here is, is this a good idea? Or is it an
idea past its time? According to some members of Congress, the anti-trust exemption actually had a place and was logical at the
time it was enacted (Sensenbrenner, 2001). Back in 1922, Major League Baseball had a grand total of 16 teams, located primarily in the Northeast and Midwest (Sensenbrenner, 2001). Players werent
paid all that well, ball parks were privately owned (mainly by huge, wealth families) and fan loyalty was dedicated to baseball stars who mainly stayed with the same team for
most, if not all their careers (Sensenbrenner, 2001). Back then, baseball could be considered in "dire financial straits," and the loss of primary assets (i.e., the players) was considered a
danger to the teams. On top of that, baseball wasnt considered legitimate business - it didnt generate money, after all - and didnt behave like a business (Sensenbrenner, 2001).
But times change. And these days, people consistently point out that the antitrust exemption enacted in 1922 is woefully out of date today,
