To weigh out the nuances of the types of charges that can result in such a scenario it is helpful to consider an incident in a bar when a wife is inspired to hit her husband in the head with a wine bottle. The wife could be charged with aggravated assault, or in some states even aggravated assault and battery, because the wine bottle would be viewed as a potentially deadly weapon. Aggravated assault is a far more serious crime than simple assault or simple battery of course because of the fact that a weapon is involved or even in cases where there is no weapon but the intent is to do serious harm (Findlaw, 2007). While simple assault and simple battery are misdemeanors, aggravated assault or aggravated assault and battery are felonies. Misdemeanors typically are punished with lighter sentences such as jail time equal to or less than one year (Lectric Law Library, 2007). Felonies, on the other hand, can be punished with life sentences or even the death sentence (Lectric Law Library, 2007). Interestingly, the charges of assault vs. battery are surrounded by many misperceptions and, in some instances, actually reflect the bias the law sometimes holds when it comes to women. While the term "assault" is reserved to instances when an individual attacks or threatens another, in cases where the two individuals are domestic partners the terminology is sometimes changed to "battery".
