States Supreme Court ruled that the application of Title IX was for federally financed programs specifically, and because sports programs did not use federal funds, they were excluded from the
Amendment. Recognizing that this was one of the underlying purposes in the Amendment, Congress passed the Civil Rights Restoration Act in 1988, which reverted to the 1972 interpretation of
the law requiring schools to comply with the equity of distribution for girls and boys sports (Block, 2002). Background of the Problem Since 1988, the clear
directive behind Title IX was to eliminate gender-based discriminatory practices in athletics programs, incluing college athletics. In the development of the Amendment, the authors of Title IX looked to
three specific components to identify compliance: Accommodation of Interests and Abilities, linked to a test of proportionality (e.g. equal representation of male and female sports areas of interest).
Athletic Financial Assistance: Scholarships - relates to higher education. Scholarship dollars and other aid must be proportionately equitable between men and women Other Program Areas: Treatment. There are 11
separate provisions that include: equipment and supplies; games and practice schedule; per diem and travel; academic tutoring; coaching; facilities; publicity; medical and training facilities and services; support services; and recruiting,
among others (Lichtman, 1998, p. 64). In order to determine that a school qualifies for continuation of federal funding, all three of these components must be met (Lichtman, 1998). Prior
