The Black Act of 1723 authorized execution as the punishment for a wide range of transgressions, from cutting down young trees to writing threatening letters (Knoll, 1994). Fast forward to twenty first century America and many opinion polls show that the majority of citizens favor the death penalty for serious crimes. At the same time, a student writing on this subject should emphasize that the debate continues. There are many groups that oppose the practice such as the ACLU. A significant reason as to why this organization opposes the death penalty is because no one can be sure that the convicted murderer is really guilty. The ACLU claims that whether or not one favors or opposes capital punishment, there a great deal of evidence to show that the judicial system is broken ("ACLU Death," 2002). A review of death penalty judgments that have spanned a 23-year time period had found a national error rate to be as high as 68 % (2002, p.PG). The system gets the verdict wrong more than 2 out of every 3 times in matters of life and death (2002). Therefore, even for that reason alone, there needs to be a moratorium on executions so that the society can take time to figure out why the system is broken (2002). Then, possibly, it is alluded that the penalty could be implemented. Of course, while that is implied, there is the sense that one cannot create a perfect system. If there is a chance of putting an innocent man to death, is it worthwhile? The answer, according to the ACLU, is a resounding no.
