now believes the war is immoral, illegal and that the U.S. should withdraw its troops immediately. The Administration, however, shows no signs of doing so, claiming that America has to
stay until the job is finished. This paper argues that from an international law standpoint, the war in Iraq is legal. Discussion It is important to recognize that there is
a substantial difference between something being legal and justified according to the letter of the law, and being morally right. Few people still believe that the Iraq War is moral:
too many of the reasons presented to the public for waging the war have been proven hollow. There is also the fact that Iraq is oil-rich, and the U.S. has
an insatiable appetite for oil, and a President with a background in the oil business. These facts alone are enough to cast doubt on the legitimacy of the U.S. presence
in Iraq. However, it is possible to find strict legal justification for the war, and that is based not on Husseins abhorrent conduct or the alleged presence of weapons of
mass destruction, but on previous Iraqi violations of provisions of international law, specifically the "breach of the 1991 cease fire" (Schmitt, 2004, p. 94). The U.S. and the U.K., in
making their legal case for war, "did not base the legality of their attack against Iraq on a self-defense argument, anticipatory or otherwise"; instead, the U.S. "addressed a letter to
the President of the Security Council in which it outlined its legal rationale for resorting to armed force" (Schmitt, 2004, p. 94). In this letter, the President stated he had
determined that "further diplomatic and other peaceful means alone will neither adequately protect the national security of the United States against the continuing threat posed by Iraq, nor lead to
