bear. This paper argues that the terrorists should not be brought to New York for trial. Discussion Kalid Sheikh Mohammed is the "self-proclaimed mastermind" behind 9/11 and he and four
others, currently detained at Guantanamo Bay, will be tried in a civilian federal court in New York City, rather than facing a military tribunal at the base (Kahlid Sheikh Mohammed
to face New York trial, 2009; hereafter "New York trial, 2009"). Two other suspects, one of whom is suspected in the bombing of the USS Cole, will be tried by
the military (New York trial, 2009). The reasons given for trying the terrorists in New York are first, that this is a first step toward closing Guantanamo; and second, that
the United States is a nation under the rule of civil law, and that even our worst enemies are entitled to its protection (New York trial, 2009). But many are
furious with the decision and pundits are already speculating on the damage this move could do to the Obama administration if the trial "suffers legal setbacks" (New York trial, 2009).
(Presumably that means if they are somehow found not guilty.) We could go on and on about the way the politicians are lining up either to praise the move or
to continue their attacks on the President, but instead lets consider other reasons why this is a poor decision; well ignore for the purposes of this paper those who approve
