This 20 page paper considers a fictitious treaty between 4 states that are all party to the 1969 Vienna Convention on the Law of Treaties, where 8 years after the treaty came into affect there are disagreements. One state is arguing that they were coerced into accepting the terms by the other states through the threat of economic sanction, and that it was a former government that ratified the treaty so it should be nullified, another believes that the state arguing this is creating a material breach, there are also arguments over reservations placed into the treaty by one of the states. The different issues are considered with reference to e convention. The bibliography cites 10 sources.

However, not all agreements will run smoothly, there can be disagreements regarding the meaning, implementation and even the presence of a treaty. This has occurred in the case supplied by the student. Four states have entered into a multilateral treaty, the forth state now want to withdraw from the treaty arguing that they were coerced to enter into he treaty with threat of economic sanction from states 1, 2 and 3, furthermore they argue that as the treaty was signed by a previous, overthrown government, they are not bound by it. Following this state 2 also decides that it wants to terminate its agreement arguing that state 4 is in a material breach, as there are no specific clauses in the treaty dealing with termination. There is a reservation that was added by State 1, and there is not prohibition on reservation, with state 1 entering a reservation when it was ratified, that stated there could be the suspension of economic cooperation if there was a threat to security. State three placed an objection to this after three months, in the grounds of incompatibility with the purpose of the treaty and opposed the treaty unless this reservation was withdrawn. State 2 also criticized the reservation 13 months after it was made, but did oppose entry into the treaty. The reservation made by State 1 is still in place.
