In this paper we will look at the legal, ethical and social responsibility issues that should be reflected in the planning function and consider the influences that impact on the strategic, tactical, operational, and contingency planning. Legal Apple has followed an aggressive strategy to gain market share and increase profits using innovation and first mover advantages. The decisions have resulted in the company facing legal action. Actions that are ongoing need to be considered in the way planning takes place. There are several legal influences at the current time. One that is potentially costly are the issue of patent breaches. In one case that is being brought against Apple by Burst.com. The law suit filed is accusing Apple of breaching four patents which belong to burst (Macworld, 2007). The patents are in areas of critical importance to Apple and include that the breaches are seen in the iTunes store, the iPod devices and the iTunes software as well a in the Mac software (Macworld, 2007). The patent breaches are methodological or process breaches which concern to the devices and methods that are used with burst transmission of both video and audio files (Macworld, 2007). The way in which patents operate it is possible that if these are breaches that they were not purposeful breaches. It should also be remembered that bringing a case does not automatically mean the claim is correct. The burst.com patent case is not the only patent case being fought by Apple.
