case was initiated because of Davis contention that an illegal search had occurred that resulted in the discovery of five kilos of heroin, which Davis maintained should be suppressed.
Facts Allan Davis lived in an apartment building in Carlisle that had four other apartments. The building had originally been a single-family home that was converted to apartments
with shared hallways and a shared entry way. On February 26, 2010, police officers saw Davis participate in what they believed to be an illegal drug sale at the
MJ Carlisle Mall. The officers subsequently followed their suspect to what they believed to be his home, where they watched Davis enter the building. They subsequently watched Davis
turn on the lights in an apartment of the first floor, and then entered the apartment building through an unlocked front door that led to the hallway connecting the apartments.
Once inside the first floor hallway, the police officers knocked on the door of the apartment they believed to be leased or owned by Allan Davis. The officers
knocked on the door and immediately announced that they were police officers. They received no response, but instead heard rapid movement in the apartment, indicating what they believed to
be the suspects attempt to flee the building. The officers forced the door open and entered the apartment, viewing Davis attempting to leave. The officers arrested Davis and
in the process, searched the apartment. The search of the apartment resulted I the location of a five kilo package of heroin, and this was confiscated and Davis charged
with possession with intent to sell and drug trafficking. After his arrest, it was later determined that Davis was not leasing the apartment where he was arrested, and instead,
