(EMTALA) is simply a provision that is included in COBRA which came about in 1986 ("American Academy of Emergency Management: EMTALA," 2008). Most people are familiar with COBRA. COBRA, for
the most part, is a piece of legislation that makes sure people are allowed to purchase health insurance when they are laid off. It does other things as well. EMTALA
is something that is a part of COBRA but has a significant impact on the population. It was actually something that came about in order to combat discriminatory
practices in health care ("American Academy of Emergency Management: EMTALA," 2008). Many people are familiar with abuses by hospitals and a failure to treat patients. In recent months, a
video has been shown on television news programs showing a dead woman in a waiting room. The patient was mentally challenged, but the triage nurses perhaps ignored the patient for
too long. It should be said that some hospitals do make poor decisions. Many of the negative decisions are in respect to transferring, refusing treatment or discharging indigent patients
("American Academy of Emergency Management: EMTALA," 2008). Why do they do this? The hospitals take such actions in part, in order to cut costs ("American Academy of Emergency Management: EMTALA,"
2008). In some cases, patients without insurance would be sent to a county hospital and while this may be par for the course, problems erupt when the patient is truly
in need of urgent care. The nurses responsibility in determining whether or not a patient can wait for treatment is critical. In the past, what would happen would be that
