Many contemporary women consider abortion one of their basic rights. Needless to say, this view is controversial to say the
least. Never-the-less, there are many that adamantly support the right of a woman to choose what she does with her body. The intent of this paper is to
explore these views and to use them to refute the various counterpoints which are often raised to argue that abortion should be banned.
The abortion debate is largely characterized by the Pro-Choice group and the Pro-Life Group. There is a third group as well in the controversy, however. That group is
comprised by those that argue that abortion is valid only when certain conditions are met. The Pro Choice group typically bases it argument on the landmark Supreme Court case
of Roe v. Wade which placed womens health above fetal interest and gave women a legal, even a Constitutional, right to abortion (Bours A9). This case was four-pronged in
its findings. It determined that the right to privacy encompassed the concept of abortion, that while there are compelling state interests in abortion the restrictions which can be put
on them must be carefully tailored in order to address those interests, that the state has no interest in fetal life prior to a certain stage of development (when the
