Alien Tort Statute and the Foreign Sovereign Immunities Act of 1976. THE HISTORY OF THE ALIEN TORT STATUTE The Alien Tort Statute was part of the Judiciary Act of
1789. It originally provided that "the district court ... shall also have cognizance, concurrent with the courts of the several States, or the circuit courts, as the case may
be, of all causes where an alien sues for a tort only in violation of the law of nations or a treaty of the United States" (DAmato PG). When the
constitution was drafted, it was felt that the Alien Tort Statute needed to be included in order to protect the United States from European nations that were at war.
This was especially important at that time because the United States was very weak in its military sector, and would be unable to stand up against the more imposing countries
such as France, Spain, or England. For this reason the Alien Tort Statute was enacted in order that this foundling country would not be taken advantage of.
