or rather the guest of a short-term renter - has discovered a collection of sterling silver items on the grounds of the beach house the tenant was renting for one
month of the summer season. The finder maintains that the items belong to him; the owner of the property claims that the items are his. The purpose here
is to assess the matter, using only Benjamin v. Lindner Aviation [(Iowa SC, 534 N.W.2d 400 (1995)] for guidance. The Situation Albert, the
tenants father and guest at the beach house, discovered a metal trunk buried on the property on which the house is located, not on a public beach. Inside was
a collection of sterling silver items such as trays, flatware, a tea service and other items. The lock was rusted closed, indicating that the trunk had been there for
some time. The items were held by the local police for a year and are being released because no one has made claim to them during that time.
Stan, the owner of the beach property, purchased the property in 1995. He claims that since the items were on his property, then
he is the rightful owner of the trunk and its contents. A local antiques dealer recognizes the maker of the items, a local
silversmith that was in business from the late 1800s until the mid-1970s. All of the silversmiths records were destroyed in a fire in the 1970s; the silversmith no longer
is in business and there is no known way to verify the age of the items. Found Property According to the summary of
