and is, a great deal of talk and controversy about the death penalty in the United States. There are many people who feel that no one has the right to
take the life of another and that through supporting the death penalty the nation is not moving towards a moral or ethical position. There are those who also believe that
people should be punished, if not eliminated, for doing serious harm to the society. They committed a crime and should receive an equal punishment. These are powerful arguments that constantly
seem to move around the nation and create a great deal of argument. But, these arguments become even more tense when the topic of the juvenile offender is brought into
the conversation. The following paper examines the issues and argues against the death penalty for juveniles. Against the Juvenile Death Penalty There are many who argue in favor
or against the constitutionality of the death penalty for adults or juveniles. The amendment in question states that a person should not experience "cruel and unusual punishment" (The International Justice
Program, 2004). The problem there is that executions are not really considered to be cruel or unusual, especially if the individual being executed conducted themselves in such a way that
they surely inflicted cruel and unusual punishment on another. For example, if a criminal rapes, mutilates, tortures, and then kills a person they are clearly engaged in cruel and unusual
