can behave badly. In some companies today, when a mental disability is involved, there is a reluctance to fire those employees due to the law, but the also law provides
that the candidate or employee must be able to do the job. Should companies bend over backward to accommodate mentally ill employees? Where is the line drawn?
1. In your opinion, does Johnson have a viable claim of disability discrimination? Explain. Does he have a claim of retaliatory discharge? Explain. It does not
seem that he has a good case in respect to discrimination. The key issues concern the fact that the employer has not made accommodations for Johnsons illness. However, despite the
fact that the physician claimed Johnson should be in a more relaxed environment due to his diagnosis of ADD, the characterization of the new supervisor is not substantial. Also, while
missing an important meeting is not always grounds for dismissal, it is likely the culmination of events that led up to the situation. Yet, Johnson refused to talk about why
he missed the meeting. If he were to be covered under the law, he would have to have a note from his physician. He cannot simply say he was out
