There are three approaches that we will consider; adoption, special guardianship order and a residence order. Adoption Adoption may be defined as " a process whereby a court irrevocably extinguishes the legal ties between a child and the natural parents or guardian and creates analogous ties between the child and the adopters" which is seen in the Adoption Act 1976 ss12 as amdened by the Childrens Act 1989 and the Adoption and Children Act 2002, also supported by the case of OConnor v A & B [1971] 1 W.L.R 1227 (Black et al, 2004). The concept of adoption law was first introduced under the Adoption Act 1926 and it is the legal transfer of the child from one family group to another. As such although this is technically the same family group adopting Steven would give Ruth and Peter all the rights and responsibilities as if they were Stevens mother and father, this would also give Steven all the rights as if he were a natural born child to them. This means as well as the official rights and responsibilities this, as a side effect, will also impact on succession rights. This will also mean there are not rights and responsibilities remain with Tanya. The Adoption and Children Act 2002 brought the Adoption Act up to date with the Childrens Act 1989 with the child being placed at the centre of the adoption process. In this ...
