abortion, a decision that is prompted by her parents. The boys parents have the girl arrested as they prove to a judge that the girl, Mary, would be putting her life in danger if she were to have an abortion in this late stage of pregnancy. The girls parents believe that they should be able to make such medical decisions without interference, but the boys parents claim that they were only trying to help. To answer several questions pertinent to this case, a student writing on this subject will want to look at the subject from a Kantian point of view, because when it comes to abortion, it seems reasonable to look for universal rules. Many questions loom large in respect to this issue, which is why abortion is so controversial. For example, should a womans right under the law be restricted even if she is past a certain stage of pregnancy? This is a very difficult question to answer. While what is sometimes called "partial birth abortion" is frowned upon, there are stages of pregnancy where the fetus perhaps is not vialbe outside of the womb, but is really too far along to render it a cluster of cells. At some point, the fetus has a face, but perhaps cannot survive on its own. The question becomes whether or not this fetus is a human being with a soul and requires protection, or if the fetus is really a part of the womans body and is not deserving of that status. It would be reasonable for a justice on the Supreme Court to render a verdict that disallows Mary to have the abortion due to viability. When is a fetus considered viable?
