the nation. The following paper examines three different articles/documents which address various levels of involvement and action in relationship to abortion on state and federal levels as it involves issues
of partial birth abortion (states and federal) and the Unborn Child Pain Awareness Act of 2005 before the Senate. Abortion: National and State While it appears, from examining
the Supreme Court website, that there are no new decisions that have recently been made concerning abortions, it also appears as though one of the most controversial and important legal
focuses concerning abortion involves the partial birth abortion. Back in 2000 the Supreme Court became involved in a case in Nebraska involving partial birth abortions. The case was accepted by
the Supreme Court "because of the conflict between the two appeals courts" (CNN, 2000). According to previous Supreme Court rulings abortions in states are regulated in association with placing
"undue burden" on the women involved (CNN, 2000). In other words, individual states have a right to create their own abortion laws as long as it does not place an
"undue burden" on the woman who desires an abortion (CNN, 2000). The state of Nebraska was attempting to outlaw partial birth abortions, claiming such a procedure does not involve any
"undue burden" (CNN, 2000). However, the Supreme Court decided that it did create such a condition and did not allow for the criminal position of the partial birth abortion. This
