Arbitration is a reasonable alternative to a court trial. In general, it takes less time, doesnt depend on the vagaries of an overcrowded
court system, is private, involves less discovery and is less expensive (Smith, 2008). The findings are just as binding as a court award, but the entire process is much, much
faster than long-dragged-out trial proceedings. For these reasons, it is becoming a popular alternative to the traditional practice of bringing suit. It is this process that is explained in the
notice. Paragraph (a) simply says that if a Comcast customer has a dispute that cannot be resolved by a more informal method, either Comcast or the customer may choose to
have the dispute arbitrated, rather than going to court. "Arbitration means you will have a fair hearing before a neutral arbitrator instead of in a court by a judge or
jury" (Notice to customers regarding policies , complaint procedures & dispute resolution, hereafter "Notice"). Paragraph (b) lists the definitions that are used in the Notice. It defines the terms
"Dispute," "Comcast" and "Arbitration Provision" (Notice). Its fairly self-explanatory, except that in defining "Dispute" the company makes an exception of the "class action waiver clause," which is referred to in
paragraph E(2). So its off to paragraph E(2) to find out what the vampire is up to. Here is says simply that parties to arbitration have to be individuals; a
