Part of the reason for this is because simply evaluating antitrust allegations on market share alone would put a lot of businesses in the violation category. There are certain industries,
for example, that have few players for various reasons. Diamond manufacturers are a good example of this - this is not an industry that is automatically open to anyone who
simply decides it would be a good idea to make diamonds. At last examination, DeBeers isnt keeping anyone out of the industry, but it is aware that the barriers to
entry (not to mention barriers exit strategies) are very high. But if one were to examine DeBeers strictly on market share or market definition, the company would be in definite
violation of some type of anti-trust law. Any kind of antitrust law, therefore, is not necessarily against monopoly or oligopoly. But what
antitrust law does enforce is types of behavior that dont encourage competition, or that make consumers worse off in the long run (Posner, 1986).
The best example of this type of scenario deals with Microsoft Corp. and the suit brought against it during the late 1990s and early 2000s. In United
States vs. Microsoft, the U.S. Department of Justice and 19 additional states sued the technology company claiming several instances of antitrust (Economides, 2001). But Justice and the states werent making
