not quite so clear cut. The "state" that Kant noted had the right to serve out murder to deter murder lies in the hands of a jury of "peers," who
need to decide, beyond a reasonable doubt, if a person is guilty or innocent of a crime. A sluggish justice system also means that those who have been proven guilty
can live for a few more years while lawyers file appeals, meaning that the punishment can fit the crime close to a decade after the crime is committed. The difference
between the 18th century views of Kant and the reality of the 21st century justice system in the United States are worlds apart. Given that, this paper will attempt to
determine if Kant was justified in his assertion that the best retribution of murder is death. As a note before beginning, please be aware that throughout this paper, the terms
"death penalty" and "capital punishment" are being used interchangeably. A history and explanation of capital punishment The main definition of capital punishment,
according to The Columbia Encyclopedia is "imposition of penalty of death by the state" (Capital Punishment, 1993). Although capital punishment has
been seen as modern society issue, death penalty laws reach as far back as 18th century B.C.E. - before the Common Era (Introduction to the Death Penalty, 2002). At that
