Title III of this Act, which is enforced the U.S. Department of Justice, prohibits restaurants from discriminating against customers who have disabilities (Americans with Disabilities Act). However, the requirements of the ADA are different depending on when the restaurant was constructed, and hold restaurants opened prior to 1993 to a less stringent standard. In order to report on a restaurant similar to one that may be in the students area--so as to facilitate the process of the student writing his or her own paper--this writer/tutor visited a local McDonalds restaurant that was built fairly recently and, therefore, should conform to all of the ADA standards. First of all, the writer noted that the on-site parking lot had the two spaces closest to the door designated for handicapped parking. These spaces appeared to meet the ADA standard of being 8-feel wide and there was a wide access aisle adjacent to each space. The space closest to the building appeared to be capable of accommodating a lift-equipped van. There was an inclined, unobstructed path leading up to the restaurant sidewalk, which was free of cracks or other impediments to wheelchair access. The ramp surface itself was textured so as to avoid slips and facilitate use, and there were secure handrails on each side of this access. The writer noted that the access on the other side of the building went up a steep incline. Checking this out, the stairs on this side of the building had secure handrails on both sides and there was a sign posted indicating that wheelchair access was available on the other side of the building, which was adjacent to the parking lot.
